The Senior Special Counsel (Clearing Agencies)position is located in the US Securities and Exchange Commission, Office of Compliance Inspections and Examinations (OCIE).

Attorneys, accountants and examiners in the Office conduct risk-based examinations of large, complex financial institutions, particularly clearing agencies, that are broad in scope and require specialized knowledge of clearance and settlement, market operations, and new complex products (including credit default swaps and other derivative products).

The Office provides legal and policy advice on law, policy, and operations relating to clearance and settlement issues, including the interrelationships between U.S. banking and securities laws, and related international issues. The Office coordinates program objectives and inspection issues with the SEC’s regional offices and provides information and assistance to other offices in the SEC engaged in clearing agency oversight. The Office also interacts with other federal and state regulators with respect to clearing agency activities and oversight. The purpose of this position is to help develop an enhanced examination program for registered and exempt clearing agencies that are subject to the SEC’s examination oversight.

Senior Special Counsel (Clearing Agencies) Responsibilities

Assist in planning and coordinating examinations with the regional offices, monitor clearing agency activities and developments, and work closely with other offices at the SEC engaged in clearing agency oversight.

Develop examination protocols and related procedures for the clearing agency program, develop and provide training on issues pertinent to clearing agency operations, and serve as a resource for staff in the Office when issues are raised within the employee’s area of expertise.

Requisites:

Applicants must have at least 52 weeks of specialized experience at the GS/SK-14 level or above (or equivalent private sector experience) to qualify.

Applicants must have specialized expertise to include the following:

(i) specialized knowledge of the U.S. clearance and settlement system and the role of clearing agencies in that system; and/or

(ii) knowledge of and experience applying the federal securities laws and rules in general as well as particularly those applicable to clearing agencies; and/or

(iii) experience in examinations.

Knowledge of the following related areas also helpful: complex derivative products, enterprise risk management, and/or the financial and operational aspects of the U.S. securities markets.

Applicant must possess superior analytic and writing skills and be able to plan, organize, and see through completion difficult and sensitive examinations that may have no precedent.

Finally, applicant must have originality and judgment in order to recommend solutions to problems identified during examinations that are in the public interest.

Applicants forSenior Special Counsel (Clearing Agencies) must possess a J.D. or LL.B. degree and be an active member of the bar in good standing in any state, territory of the United States, the District of Columbia, or the commonwealth of Puerto Rico.
